news2use Terms and Conditions
You (the “Broadcaster”) agree by downloading footage offered on the website (“news2use”), to accept the following Terms and Conditions:
§ 1 Usage Rights
RTV GmbH distributes all footage on behalf of the mentioned companies. RTV GmbH and/or the respective company maintain the right to withdraw news2use and the contained footage, or refuse to provide service without the need for prior announcement or written justification. In case of the withdrawal of news2use and/or the contained footage, RTV GmbH cannot be made liable for any damages whatsoever arising thereof.
Unless provided otherwise, Broadcaster is granted the non-exclusive, non-transferable and non-sub licensable right to use the footage offered on news2use free of charge for world-wide television broadcasting, mobile phone TV and non-linear on-demand services . The footage may be used for an unlimited number of reruns and an unlimited period of time. In some cases the usage will be limited for a certain period of time. This will indicated clearly and the Broadcaster is bond to obey it.
§ 2 Restrictions
Broadcaster has to observe all rights and usage restrictions indicated in the present Terms and Conditions and in connection with the respective footage. In case of doubt, a written permission has to be obtained from RTV GmbH prior to broadcasting.
The Broadcaster may not convey, sell, sublicense, assign or transfer rights provided by the present Terms and Conditions. In particular independent re-distribution of the footage or commercial use is prohibited. The editorial content may not be distorted and has always to be in the original context of the feature. In general the best way is to use the news2use ready to air service. Sponsoring intros and outros may be used at the discretion of the broadcaster. Internet platforms may not publish footage without editing it. But interviews und edited clips may be used. In some cases the usage will be restricted such as Champions League footage which shall not be used separately out of the context. But in case of special requests, please contact us.
In case of disregard of these before mentioned Restrictions the Broadcaster is obliged to pay a penalty to RTV GmbH of € 20.000,00 for each case of disregard. Furthermore, disregard of the mentioned Restrictions will be pursued in civil- as well as in criminal-law proceedings.
RTV GmbH has taken care and fully paid all music rights of videos on news2use. However broadcaster is solely responsible for collection agencies fee with respect to the use of music in footage and is obliged to pay this fees.
§ 3 Miscellaneous
RTV GmbH cannot be made liable for any non-compliances or damages with any laws, particularly if the Broadcaster places the footage in an illegal surrounding of contents. The Broadcaster is responsible that the content does not violate broadcast restrictions nor national or regional laws.
§ 4 Applicable Law
The present Terms and Conditions will be governed in all respects by the laws of the Federal Republic of Germany, without reference to its laws relating to conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. The exclusive place for jurisdiction for any lawsuits arising out of or relating to the present Terms and Conditions is Böblingen, Germany.
